Actually the historical context of this passage tells us that Muhammad and his Muslims had just relocated to Medina and weren't even under attack by their Meccan adversaries. So it is once again, not defensive warefare, infact, the verses urge offensive warfare, in that Muslims are to drive Meccans out of their own city as i stated in my previous comment.

And also claims 9:41 is vulgar and clear in its wordings and that all muslims should follow it.

Yes, muslims are commanded to make jihad, so what ?

he agreed  and acknowledged that Muslims were merciful should they have won. This is due to the fact that Muslims at that time were not made of combatant  abled soldiers.
