Above hadith is regarding Jews of Khaybar (who tried to kill Prophet and were against Islam and Muslims), It is mentioned in Commentary of Sahih Bukhari Vol # 4 Page no: 524 by Muhammad Dawud Raaz (Rah)(Markazi Jamiyat Ahlul hadeeth hind), under the commentary of this hadith

 Prophet peace be upon him intended to expel Jews in his life but he died. Umar RadhiAllahanho expelled them in his rule due to their continuous betrayl and Conspiracies (against Islam and Muslims).

 

Prophet peace be upon him said Bukhari Volume 4, Book 53, Number 391:Narrated 'Abdullah bin 'Amr:

The Prophet said, "Whoever killed a person having a treaty with the Muslims, shall not smell the smell of Paradise though its smell is perceived from a distance of forty years."

 

 

 

Allah ordered Prophet peace be upon him in Surah 109 : Say: O disbelievers! I worship not that which ye worship; Nor worship ye that which I worship. And I shall not worship that which ye worship. Nor will ye worship that which I worship. Unto you your religion, and unto me my religion.

 

Surah 16:125:  Invite (all) to the Way of thy Lord with wisdom and beautiful preaching; and argue with them in ways that are best and most gracious: for thy Lord knoweth best, who have strayed from His Path, and who receive guidance.

 

    Also note that Prophet peace be upon him never killed anyone with his own hand, except Ubayy ibn Kahlaf who tried to kill Prophet peace be upon him, It is mentioned in Fatwa no: 20181 of Islam qa

 

Al-Bukhaari (4073) and Muslim (1793) narrated that Abu Hurayrah (may Allaah be pleased with him) said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “The anger of Allaah is most intense against a man who is killed by the Messenger of Allaah for the sake of Allaah (on the battlefield).”

 

Al-Nawawi said:

“For the sake of Allaah” excludes one whom he kills as a hadd punishment or by way of legal retaliation (qisaas), because whoever is killed by the Prophet (peace and blessings of Allaah be upon him) on the battle was intending to kill the Prophet (peace and blessings of Allaah be upon him).

 

It is not known that the Prophet (peace and blessings of Allaah be upon him) killed anyone among the mushrikeen with his own hand apart from Ubayy ibn Khalaf.

 

That was narrated by Ibn Jareer and al-Haakim from Sa’eed ibn al-Musayyab and al-Zuhri (may Allaah have mercy on them). Ibn Katheer said in his Tafseer (2/296): its isnaad is saheeh.

الكَمَال: التَّمام، وقيل: التَّمام الذي تَجَزَّأَ منه أَجزاؤه، وفيه ثلاث لغات: كَمَل الشيء يَكْمُل، وكَمِل وكَمُل كَمالاً وكُمولاً، قال الجوهري: والكسر أَرْدَؤُها.
وشيء كَمِيل: كامِل، جاؤوا به على كَمُل؛ وأَنشد سيبويه: على أَنه بعدما قد مضى ثلاثون للهَجْر حَوْلاً كَميلا وتَكَمَّل: ككَمَل.
وتَكامَل الشيء وأَكْمَلْته أَنا وأَكْمَلْت الشيء أَي أَجْمَلْتُه وأَتممته، وأَكْمَلَه هو واستكْمَله وكَمَّله: أَتَمَّه وجَمَلَه؛ قال الشاعر: فقُرَى العِراق مَقِيلُ يومٍ واحدٍ، والبَصْرَتان وواسِط تَكْمِيلُه قال ابن سيده: قال أَبو عبيد أَراد كان ذلك كله يُسار في يوم واحد، وأَراد بالبصرتين البصرة والكوفة.
وأَعطاه المال كَمَلاً أَي كامِلاً؛ هكذا يتكلم به في الجميع والوُحْدَان سواء، ولا يثنى ولا يجمع؛ قال: وليس بمصدر ولا نعت إِنما هو كقولك أَعطيته كُلَّه، ويقال: لك نصفُه وبعضه وكَماله، وقال الله تعالى: اليومَ أَكْمَلْت لكم دينَكم وأَتْمَمْتُ عليكم نِعْمتي (الآية)؛ ومعناه، والله أَعلم: الآن أَكْملتُ لكم الدِّين بأَنْ كفيتكم خوف عدوِّكم وأَظْهَرْتَكم عليهم، كما تقول الآن كَمُل لنا المُلْك وكَمُل لنا ما نريد بأَن كُفينا من كنَّا نخافه، وقيل: أَكمَلتُ لكم دِينكم أَي أَكْملتُ لكم فوق ما تحتاجون إِليه في دِينِكم، وذلك جائر حسَن، فأَما أَن يكون دين الله عز وجل في وقت من الأَوقات غير كامِل فلا

"Having fully perceived that Muhammad (Peace be upon him) could never be desisted from his Call, Quraish, in a desperate attempt to quell the tidal wave of the Call, resorted to other cheap means acting from base motives:

    Scoffing, degrading, ridiculing, belying and laughter-instigating cheap manners, all of which levelled at the new converts in general, and the person of Muhammad (Peace be upon him) in particular, with the aim of dragging the spirit of despair into their morale, and slackening their ardent zealotry. They used to denounce the Prophet (Peace be upon him) as a man possessed by a jinn, or an insane person:

    And they say: O you [Muhammad (Peace be upon him) ] to whom the Dhikr (the Qur'an) has been sent down! Verily, you are a mad man. [15:6]

     

    or a liar practising witchcraft,

     

    And they (Arab pagans) wonder that a warner [Prophet Muhammad (Peace be upon him) ] has come to them from among themselves! And the disbelievers say: This [Prophet Muhammad (Peace be upon him) ] is a sorcerer, a liar. [38:4].

     

    Their eyes would also look at the good man as if they would eat him up ' , or trip him up, or disturb him from the position of stability or firmness. They used all sorts of terms of abuse madman' or one possessed by an evil spirit', and so on:

     

    And verily, those who disbelieve would almost make you slip with their eyes through hatreds when they hear the Reminder (the Qur'an), and they say: Verily, he [Muhammad (Peace be upon him) ] is a madman! [68:51]

     

    Amongst the early converts, there was a group who had unfortunately no strong clan at their back to support them. These innocent souls were ridiculed and jeered in season and out of season. Referring to such people, the highbrow Quraish aristocrats used repeatedly to ask the Prophet (Peace be upon him), with jest and scorn:

     

    Allah has favoured from amongst us? [6:53]

     

    And Allah said:

     

    Does not Allah know best those who are grateful? [6:53]

     

    The wicked used to laugh at the righteous in many ways:

    They would inwardly laugh at their Faith, because they felt themselves so superior.

    In public places, when the righteous passed, they used to insult and wink at them,

    In their own houses, they would run them down.

    Whenever and wherever they saw them, they reproached and called them fools who had lost their way. In the Hereafter, all these tricks and falsehoods will be shown for what they are, and the tables will be reversed. Allâh had said:

Verily! (During the worldly life) those who committed crimes used to laugh at those who believed; and whenever they passed by them, used to wink one to another (in mockery); and when they returned to their own people, they would return jesting; and when they saw them, they said: Verily! These have indeed gone astry!' But they (disbelievers, sinners) had not been sent as watchers over them (the believers). [83:29-33]"

In the Name of Allah, the Most Gracious, the Most Merciful.

 

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 

First and foremost, an apostate is killed simply because it is an order of the Sharī’ah.  We do not have any authority in questioning the law of Allah.  Allah Ta’ālā is the All-Wise.  The wisdoms and benefits behind His every ruling are unfathomable by our feeble minds.

 

The possible rationale behind this ruling may be understood through the death penalty executed in almost 60 countries.  For some criminal convictions where the death penalty is carried out are:

 

    The United States of America
    China
    Japan
    Taiwan
    Thailand
    Jamaica
    India

 

A person is condemned to death because he has committed an unforgivable crime.  A country is based on certain entrenched values.  There is no compromise on such values.

 

One who opposes these values is convicted of treason.  The penalty of treason in many countries is death.  If death is the consequence of rebelling against man made laws which are deficient, then shouldn’t rebellion against the laws of Allah which are perfect be viewed more seriously.

 

An apostate fuels widespread disorder and confusion.  His apostasy prompts others to question their beliefs.  He is the seed of imbalance.  Hence, it is better to uproot the mischief before it is deep rooted in the ground.  For example, if there is a basket of apples wherein there is one rotten apple, what will the owner of the apples do? He will get rid of the rotten apple to preserve the rest of the apples.  If he keeps the rotten apple merely because it is an apple, he will be deemed foolish.  In the very same manner, an apostate carries rotten beliefs; he must be removed from the basket of the world to preserve the spiritual welfare of others.  Anything which is a threat to Imān will be uprooted.

 

You further enquire regarding the following verse:

 
لَا إِكْرَاهَ فِي الدِّينِ قَدْ تَبَيَّنَ الرُّشْدُ مِنَ الْغَيِّ فَمَنْ يَكْفُرْ بِالطَّاغُوتِ وَيُؤْمِنْ بِاللَّهِ فَقَدِ اسْتَمْسَكَ بِالْعُرْوَةِ الْوُثْقَى لَا انْفِصَامَ لَهَا وَاللَّهُ سَمِيعٌ عَلِيمٌ (سورة البقرة 256)

“There shall be no compulsion in [acceptance of] the religion. The right course has become clear from the wrong. So whoever disbelieves in Taghut and believes in Allah has grasped the most trustworthy handhold with no break in it. And Allah is Hearing and Knowing.” (Quran 2:256)

 

This verse orders the believers not to coerce anybody into accepting the fold of Islam.  This verse has nothing at all to with an apostate.  In this verse, Muslims are being reminded not to make people accept Islam by means of compulsion.  Hence, history testifies that all the cities which accepted Islam in the earlier times was due to them exercising their free will.  Forcing somebody to accept has no benefit at all.  It just creates more enemies from within.

 

An apostate had already entered Islam with his own will and then he defected.  He will not be forced to accept Islam.  He will be given an opportunity of three days to repent.  After three days, the apostate will be sentenced to death.[ii]

 

You also ask vis-à-vis chapter 109 titled surah al-kāfirūn.  Before explaining this chapter, it is necessary to understand that all these contradictions and misunderstandings are due to understanding texts out of their context.  One must study under a qualified and genuine scholar to really comprehend the message of the Qur’an.

 

Firstly, this verse was revealed in Makkah.  Hence, it preceeds any ruling in relation to apostates.  Secondly, this chapter was revealed with regards to a specific occurrence.  Once the disbelievers came and proposed to the Prophet salallahu alaihi wasallam that they should practice on a ‘multi-faith’; for one year, everybody should worship the idols and the next year everyone will worship Allah.[iii] It was after this that the Prophet was told to respond to them with the statement:

 
لَكُمْ دِينُكُمْ وَلِيَ دِينِ (سورة الكافرون 6)

“For you is your dīn for me is my dīn.” (Quran 109:6)

 

In conclusion, if opposition to the values of man-made laws is unforgiveable, imagine the severity of going against the core values of Islam, namely Tawhīd?

The punishment for apostasy originated due to the dangerous phenomena of hypocrisy (nifaq) that threatened the community in Medina. Hypocrisy in this sense is not simply failing to live up to one’s stated moral standards, but rather this form of hypocrisy was the deliberate attempt by the enemies of Islam to pretend to be Muslims in order to infiltrate and harm the community.

Allah said:

    وَقَالَت طَّائِفَةٌ مِّنْ أَهْلِ الْكِتَابِ آمِنُوا بِالَّذِي أُنزِلَ عَلَى الَّذِينَ آمَنُوا وَجْهَ النَّهَارِ وَاكْفُرُوا آخِرَهُ لَعَلَّهُمْ يَرْجِعُونَ

    A faction of the People of the Book say to each other: Believe in that which was revealed to the believers at the beginning of the day and reject it at its end that perhaps they will abandon their religion.

    Surah Ali Imran 3:72

Some of the Jews of Medina pretended to be Muslims outwardly with the intention of later publicizing their rejection of Islam in an attempt to shake the faith of newly converted Muslims. This was at a time when Medina was threatened with a war of extermination by the Quraish aristocracy.

Major apostasy is when a person embraces Islam and later leaves the religion while combining this with the political crime of treason. Legal punishment against such persons can only be carried out by a lawful authority according to due process, and it is not permissible for individual Muslims to carry out this punishment on their own.

The presence of political treason as a condition for punishment is made clear in an authentic tradition.

Abdullah ibn Mas’ud reported: The Messenger of Allah, peace and blessings be upon him, applied legal punishment in the following case:

    وَالتَّارِكُ لِدِينِهِ الْمُفَارِقُ لِلْجَمَاعَةِ

    The one who leaves his religion and separates from the community.

The mention of one who “separates from the community” (al-mufariq lil-jama’ah) indicates that a person is not legally punished simply for leaving Islam, but rather for high treason against the Muslim community.

It was narrated that al-Miqdaam ibn Ma’di Yakrib said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “The martyr has six blessings with Allaah:

1-He will be forgiven from the first drop of blood shed;
2-He will be shown his place in Paradise;
3-He will be protected from the torment of the grave;
4-He will be safe from the greater terror; a crown of dignity will be placed on his head, one ruby of which is better than this world and everything in it;
5-He will be married to seventy-two wives from al-hoor al-‘iyn; and
6-He will intercede for seventy of his relatives.”

Narrated by al-Tirmidhi, 1663; Ibn Maajah, 2799; classed as saheeh by al-Albaani in Saheeh al-Tirmidhi.

He converted to Islam before the conquest of Mecca and immigrated to the Prophet(P) [i.e. in Medina]. he embraced Islam after the Hijrah and joined the Muslims in Medina. Thus, his apostasy occurred later which means it occurred in Medina.

Concerning Chapter 6 (from which the verse 6:93 is quoted), many reports support the fact that it was entirely revealed in Mecca. They also go on saying that this Chapter was escorted by 70,000 angels when Gabriel carried it down to the Prophet.

In a nutshell, Ibn Abî Sarh embraced Islam after the Muslims had immigrated to Medina. He took the trouble to migrate to Medina where he became one of the scribes of the Prophet. For an unknown reason, he apostatized and went back to Mecca. He is supposed to have told the Meccans that he changed the Qur'ân according to his own will. This seems to be very predictable for someone in his situation seeking the favours of the Meccans whom he betrayed not a long time before. Abdullâh was among the bunch that had to be executed but he could benefit of Uthmân's intercession and he kept his life safe. Though the beginning of his Islam was unstable (he migrated then apostatized then converted back to Islam in a very short time), he became a good Muslim and was even made the commander of Muslim troops.
